REQUEST FOR QUALIFICATIONS ("RFQ") A. Request for Construction Manager at Risk Statement of Qualifications Phelps Health ("Phelps Health") is a county hospital organized under Chapter 205 of the Revised Stattues of Missori, and is seeking a qualified Construction Manager ("Construction Manager") to assist Phelps Health in developing and implementing the Project described below. Phelps Health desires to retain a Construction Manager on an "at-risk" basis, as permitted in § 67.5050 RSMo. Phelps Health has disclosed its intent to use this procurement method and the selection criteria at an open and public regular board meeting at least one week prior to the publication of this RFQ. Phelps Health is also in the process of selecting design professionals to develop the design for the Project. Phelps Health is issuing this RFQ in accordance with the procedures established in § 67.5050 RSMo. to solicit qualifed Construction Managers to submit statements of qualification ("Statement of Qualification") as requested herein. B. Project Summary and Preliminary Scope of Work The Project is a capital improvement project at Phelps Health's facilities located in Missouri (the "Project), consisting of certain capital renovations and improvements to complex components located on the main campus in Rolla, Missouri, except as otherwise noted below. The current budget for the Project is approximately $10,800,836, but is subject to change. Phelps Health reserves the right to modify the budget or scope at any time. The Project shall consist of one or more phases of work, as determined by Phelps Health, with the entire Project to be completed not later than December 31, 2024. Requirements of Construction Manager Please take into consideration that Phelps Health is subject to Missouri public procurementrequirements and the contract that is entered into with the Construction Manager will comply with all such procurement requirements as set forth in Missouri law, including, without limitation, § 67.5050 RSMo., applicable to construction managers at-risk. In addition, note that the selected Construction Manager may be permitted, in Phelps Health's sole discretion, to self-perform certain portions of the Project. In the event that Phelps Health permits the selected Construction Manager to self-perform portions of the Project, the Construction Manager will be required to submit sealed bids in order to comply with the provisions of § 67.5050 RSMo. Additionally, the selected Construction Manager will be required to (i) abide by the most current Wage Order, and as the same is updated throughout the Project, promulgated by the Missouri Department of Labor, (ii) certify that the selected Construction Manager is not engaged in a boycott of the State of Israel, (iii) certify that the selected Construction Manager does not utilize the labor or services of undocumented immigrants, (iv) provide payment and performance bonds with respect to the Project as required by § 107.170 RSMo., (v) require all on-site employees to undergo the safety training described at § 292.675 RSMo., and (vi) ensure that all manufactured goods and commodities used for the Project are manufactured or produced in the United States, and such other laws as are applicable to Phelps Health. Finally, the selected Construction Manager will be expected to comply with all of Phelps Health's insurance requirements, which may involve procuring and maintaining a builder's risk policy throughout the course of the Project. D. Construction Manager Selection Process This RFQ is being advertised by publication in the following newspapers (or by a virtual notice procedure) in the manner required by § 67.5050 RSMo.: Rolla Daily News, STL Post Dispatch and Sprinfield News Leader. Interested Constructions Managers should submit their Statements of Qualification to Phelps Health in accordance with the instructions contained in this RFQ. Upon receipt and review of the Statements of Qualification, Phelps Health will select up to five Constructon Managers to submit additional information, and to respond to a request for proposal. Phelps Health will select the bid or proposal that offers the best value for Phelps Health, based on the criteria given. Further information on this procedure is set forth below. Phelps Health reserves the right, at any time and from time to time, to: withdraw this RFQ or any request for proposal; to waive any defects in the bidding process; to change the budget or scope of the Project; to change or withdraw notices to prosposective Construction Managers; to not perform the Project or portions of the Project; to issue clarifications; and to otherwise make such revisions, changes or modifications to the process and substance of the Project as it deems neceessary in its sole discretion. 1. Firm Name, Address, Phone Number, Point of Contact 2. Healthcare Experience - List all healthcare projects completed in the last 5 years - Provide three Owner references 3. Provide an overview of your firm's Construction Manager Capabilities - Preconstruction (including Budget, Schedule, BIM) - Construction (include Safety & Quality Programs) Please include your EMR (Experience Modifier Rate) for the last three years. - A description of your company's ICRA (Infection Control Risk Assessment) policies. - A description of your company's last three year safety rating. - A description of Bonding Capabilities 4. Leadership Team - Organizational Chart - Resumes 5. Selection Criteria - Address how your firm satisfies the selection criteria set out below 6. Provide a summary describing why your firm is the most qualified resource and would provide value in assisting Phelps Health for this effort (two-page maximum). Note: Interested Construction Managers are prohibited from submitting any pricing or fee information with its Statement of Qualifications; the inclusion of such information may result in disqualification of the interested Construction Manager. Statements of Qualifications should thoroughly address all of the items above. Responses that do not address all of these items may be considered incomplete and shall not be considered. Please keep response to less than 26 pages. Statements of Qualifications must be provided in an 8½" x 11" format, bound and containing an executive summary, followed by the above requested information. Phelps Health may issue clarifications or additional requirements and information by one or more addenda. Any oral responses to inquiries shall be unofficial and not binding on Phelps Health. All information contained within this RFQ and submitted by interested firms will be considered confidential, subject to the requirements of law. Your response to this request is appreciated. 2. Selection Criteria Phelps Health will use the following criteria as principal considerations to evaluate RFQ submittals: - Construction Manager's overall qualifications and healthcare experience, past performance & capabilities - Construction Manager's safety record, including safety rating (EMR Score) - Construction Manager's proposed personnel, including leadership team - depth of resources - Construction Manager's methodology, including project controls - quality, budget, and schedule - Firm's ability to provide value to Phelps Health - Financial Strength - Demonstration of good faith efforts to achieve compliance with federal, state, and local affirmative action requirements - References of owners for whom construction management has been performed - The Demonstration of successful management systems employed for the purposes of estimating, scheduling, and cost controls. 3. Opening of Statements of Qualification The Statement of Qualifications will be publicly opened by May 26, 2023, and the names of all of the Construciton Managers submitting Statements of Qualification shall be read aloud. 4. Ranking of Interested Construction Managers Within forty-five days after the date of the opening of the Statements of Qualifications, Phelps Health will evaluate and rank each Statement of Qualification submitted pursuant to the selection criteria set forth above. Phelps Health may request additional information (including price and fee information) from up to five Construction Managers, and for such Construction Managers to respond to a request for proposal. 5. Remainder of Bidding Process and Selection Critera Phelps Health will provide to any Construction Manager selected in the above process additional information regarding the final selection of the Construction Manager for the Project. Phelps Health will select for the Project the Construction Manager that submits the proposal that offers the best value for Phelps Health based on the above criteria and its ranking evaluation, and price, as required by law. E. Construction Manager Agreements 1. Statements of Qualifications submitted pursuant to this RFQ shall be good and may not be withdrawn for a period of sixty (60) calendar days after the scheduled closing time and date for receiving Statements of Qualifications. 2. By submitting Statements of Qualifications, each interested Construction Manager agrees to indemnify and hold Phelps Health harmless from and against all losses, judgments of every nature and description made, brought or recovered against Phelps Health by reason of any act or omission of the interested Construction Manager, its agents, consultants and employees. 3. By submitting Statements of Qualifications, the interested Construction Manager acknowledges that Phelps Health is subject to the provisions of Missouri's Sunshine Laws (§§ 610.010-.225 RSMo.), which statute creates a presumptive rule of public availability of all records held by public governmental bodies, such as Phelps Health, unless an exemption from disclosure is available under the Missouri Sunshine Laws (this includes all Statements of Qualifications that are not exempt from disclosure). 4. Phelps Health will contract with the selected Construction Manager using Phelps Health's form of contract (AIA A133), along with the AIA documents related thereto.
